1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "lotusminast" / "we" / "us" / "our" — lotusminast, a financial education provider registered and operating in Chiang Mai, Thailand.
• "Service" — the financial education workshops, programs, and related materials offered by lotusminast.
• "Participant" / "you" / "your" — any individual who registers for, attends, or otherwise engages with our Services or website.
• "Program" — any specific workshop or educational series offered by lotusminast, including Retirement Planning Foundations, Investment Awareness Program, and Estate & Legacy Planning Workshop.
• "Agreement" — these Terms and Conditions, together with any program registration confirmation.
• "Content" — all materials, workbooks, templates, slides, documents, and information provided by lotusminast as part of the Service.

2. Acceptance of Terms

By submitting an enquiry through our website, registering for a program, or attending any session, you agree to be bound by these Terms and Conditions. If you do not agree, please do not proceed with registration or attendance.

To participate in our programs, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement.

These Terms are governed by the laws of the Kingdom of Thailand.

3. Service Description

lotusminast provides financial education workshops for adults aged 40 and above. Our programs are designed to improve financial literacy and awareness — they are educational in nature and do not constitute financial advice, investment advice, legal advice, or any form of regulated financial service.

Nothing communicated during any session, in any materials, or through any channel by lotusminast or its educators should be construed as a recommendation to purchase any financial product, make any particular investment, or take any specific legal action.

Programs are conducted at our premises at 318/4 Nimmanhemin Road, Suthep, Mueang Chiang Mai, Chiang Mai 50200, unless otherwise stated in writing.

4. Registration and Enrollment

Enrollment in a program is confirmed upon receipt of full payment and a written confirmation from lotusminast. Enrollment is subject to availability — programs are limited to a maximum of twelve participants per session.

We reserve the right to decline enrollment where, in our reasonable judgment, a program is not suitable for the prospective participant's stated circumstances or needs.

Account security and confidentiality of any access materials provided are the responsibility of the enrolled participant.

5. Participant Responsibilities

By enrolling in a program, you agree to:

• Treat all facilitators and fellow participants with courtesy and respect.
• Not record, photograph, or reproduce any session or materials without prior written consent from lotusminast.
• Keep confidential any personal or financial information shared by other participants during group discussions.
• Not use program materials for commercial redistribution, resale, or instruction to others without written permission.
• Arrive on time and engage constructively with the session format.

Participants who behave in a way that disrupts the session or compromises the experience of others may be asked to leave without refund.

6. Intellectual Property

All Content provided by lotusminast — including but not limited to workbooks, slide materials, template documents, and reference guides — remains the intellectual property of lotusminast.

Upon enrollment, you are granted a personal, non-exclusive, non-transferable license to use the Content for your own private, non-commercial purposes. This license does not permit you to copy, distribute, publish, sell, or create derivative works from the Content.

The lotusminast name and logo are proprietary and may not be used without prior written consent.

7. Payment Terms

Program fees are stated in Thai Baht (THB) and are payable in full prior to the commencement of the first session, unless a payment arrangement has been agreed in writing.

We accept bank transfer to our designated account. Details are provided upon registration confirmation. Fees are inclusive of all session materials and, where applicable, private advisory sessions and template documents.

lotusminast reserves the right to adjust program fees for future intake cycles. Any change in fees will not affect confirmed enrollments where payment has already been made.

8. Cancellation and Refund Policy

We understand that circumstances change. Our cancellation terms are as follows:

• More than 14 days before the first session: full refund, less any bank transfer processing charges.
• 7–14 days before the first session: 50% refund.
• Less than 7 days before the first session: no refund. A transfer of enrollment to a future intake cycle may be considered at our discretion.

If lotusminast cancels a program for any reason, enrolled participants will receive a full refund or the option to transfer to the next available intake cycle.

9. Disclaimers

Our Services are provided for educational purposes only. lotusminast does not hold a license to provide financial advice, investment advice, or legal advice under applicable Thai law, and nothing in our programs constitutes such advice.

We make reasonable efforts to ensure that all Content is accurate and current at the time of delivery. However, financial regulations, tax laws, and legal frameworks in Thailand change over time, and participants should seek independent professional advice before making any financial or legal decisions.

lotusminast makes no representation that participation in any program will lead to any specific financial outcome.

10. Limitation of Liability

To the fullest extent permitted by Thai law, lotusminast's total liability to any participant in connection with our Services shall not exceed the program fee paid by that participant.

We shall not be liable for any indirect, consequential, or incidental loss arising from participation in our programs, reliance on program Content, or decisions made based on information received during sessions.

Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be excluded under Thai law.

11. Indemnification

You agree to indemnify and hold lotusminast, its educators, and staff harmless from any claim, loss, damage, or expense (including reasonable legal fees) arising from your breach of these Terms, your conduct during any session, or any misuse of program Content.

12. Termination

Either party may terminate the enrollment agreement with written notice. lotusminast may terminate a participant's enrollment without refund if the participant breaches these Terms, behaves in a manner disruptive to other participants, or engages in conduct that conflicts with our community standards.

Sections relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination of any enrollment agreement.

13. Dispute Resolution

If you have a concern or complaint, we encourage you to contact us directly in the first instance at [email protected]. We will make every reasonable effort to resolve the matter informally within 30 days.

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Chiang Mai, Thailand.

14. General Provisions

Entire Agreement: These Terms, together with any program registration confirmation, constitute the entire agreement between you and lotusminast regarding the Services.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.

Waiver: Failure to enforce any provision of these Terms on any occasion does not constitute a waiver of that provision.

Assignment: You may not transfer your enrollment or rights under these Terms to another person without our written consent.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last Updated" date. For enrollments already in progress, the Terms in effect at the time of enrollment apply unless you expressly agree to updated Terms.
